In Canada, most foreign workers can only secure jobs with companies that have an approved Labour Market Impact Assessment (LMIA) job.

Closed Work Permit: This permit allows you to work for up to 48 months in Canada, is specific to an employer, and you can change only jobs with the government’s approval.

Live in Caregiver Work Permit: This permit allows you to work for up to 48 months in Canada, is specific to an employer, and you can change only jobs with the government’s approval.

Seasonal Work Permit: This permit allows you to work for up to 8 months in Canada, usually between March and November, but may change depending on the industry and you can change only jobs with the government’s approval.

International Experience Canada Work Permit: You must be under 35 years of age to apply for this work permit. This permit allows you to work and travel for up to 48 months in Canada and is not specific to an employer.

Spousal Open Work Permit: Your spouse must hold a valid Canadian Work permit to apply for this work permit. This permit allows you to work for up to 48 months in Canada, is not specific to an employer, and you can change jobs at any time you like.

How long does it take to get a work permit? It can take from a few weeks to several months depending on which country you are a citizen of. For a more accurate timeframe please check the Government of Canada’s website here

Do I have to leave Canada when my work permit expires? This will depend on your situation. If you have applied for a work permit extension or have submitted another immigration application you may stay. If not, you should return to your country of citizenship.

Can I bring my family with me to Canada?
The type of job and the associated government of Canada NOC (National Occupation Classification) code will determine if your spouse and children are able to come to Canada. Normally higher wages or skilled jobs allow this.

Can I change jobs on a closed work permit?
Yes, it is possible to change jobs, however, you will need to apply for approval from the government of Canada.

Can I become a permanent resident if I get a job in Canada?
Many jobs can lead to permanent residence in Canada. Your eligibility will depend on a number of factors such as your current job, Canadian work experience, language skills, etc.

In the USA, there are a number of different Work Visa Options. Most foreign workers can only secure jobs with companies that have the proper U.S. Department of Labor Certification, verifying that there are insufficient workers with this skillset within the United States, and the hiring does not take a job away from a U.S. citizen.

A. Temporary, Non-Immigrant Visa

H VISAS: These visas are for people who want to work in the United States for a fixed period of time.

H VISAS

H-1B Visas are specific to a professional or academic field or unique expertise for people who have a minimum of a college degree or higher, or the equivalent in work experience. These visas have a residency cap of three years. Usually, this visa applies to occupations such as IT, finance, engineering, and architecture.


H-2A and H-2B Visas are for seasonal work, or for a period of time based on demand or need. This visa applies to temporary workers in an agriculture (H-2A) or non-agricultural (H-2B) setting. Generally, these visas are valid for up to 1 year and can be extended yearly up to a maximum of 3 years.


B. Permanent (Immigrant) Workers

If you have the right job skills, you and your spouse and children can apply for the roughly 140,000 employment-based green cards available each year. Permanent residence in the U.S.A. is available with the right combination of education, expertise, eligibility, and skill sets.

SECOND PREFERENCE EB-2

EB-2 Visas are attainable by professionals with an advanced degree or foreign equivalent;  by people who can demonstrate at least 10 years of experience in a specific required field; or by people whose employment is in the national interest of the U.S.A

THIRD PREFERENCE EB-3

EB-3 Visas are attainable by those holding a bachelor’s degree, or foreign equivalent, as well as skilled and unskilled labourers who have a non-temporary offer of employment from a U.S. employer.


How long does it take to get a Work Visa? Normally, it takes 90 days, but with the current U.S.A. Citizenship and Immigration Services backlog it is taking 5 to 7 months.

Do I have to leave the U.S.A. when my Work Visa expires?

This will depend on your situation. Your authorized period status does not end when your visa expires. When you were admitted to the United States, your authorized period of stay was recorded on your admission stamp or paper Form I-94, called an Arrival/Departure Record. However, you require a valid visa to enter the U.S.A. H1B, H2A & H2B workers should leave immediately, however, a 10-day grace period may be granted beyond the expiration of the employment authorization.

May I bring my family with me to the U.S.A.?
The type of job and the associated government visa will determine if your spouse and children are able to come to the U.S.A. Normally, permanent (immigrant) worker jobs allow spouses and families to join the immigrant employee. With temporary non-Immigrant visas, spouses and family members need to file for their own visas before coming to the U.S.A.

Can I change jobs on a Work Visa?
H1B, H2A & H2B work visas can’t be changed from one employer to another. However, you can change to another employer during your stay for your next job, once your current visa expires.

Can I become a permanent resident if I get a job in the U.S.A.?
You may be eligible to become a lawful permanent resident of the United States based on a permanent offer of employment in the U.S.A.
